CCTV covered by legislation

I refer to the letter published in Maltatoday of 3rd August 2008 under the heading “CCTV not covered by legislation: it’s a fact”.
The correspondent has erroneously stated that the use of CCTV for local enforcement purposes is not covered by legislation. Whilst it is true that CCTV cameras are different from speed monitoring devices, the use of CCTV for the purpose of enforcing those contraventions delegated to Local Councils is sanctioned by a legal notice issued under the Commissioners for Justice Act. Legal Notice 350 of 2004 includes the use of CCTV as one of the tools for enforcing those contraventions delegated to Local Councils, including motor vehicle regulations, traffic regulations, and contraventions related to waste dumping.
The use of CCTV as a local enforcement tool is, therefore, covered by legislation and not as erroneously stated by your correspondent.

Natalino Attard
Director, Local Government
