Chemimart CEO hits out at Chamber of Pharmacists

Reginald Fava, CEO of Chemimart Ltd, has reacted to the Chamber of Pharmacists statement on the issue of a temporary license to enable him to transfer his pharmacy from Freedom Square to his outlet in Republic Street.
In a statement the Chamber of Pharmacists said that the decision by Judge Joseph Zammit McKeon was illegal and set a dangerous precedent.
However Fava states that “it is arrogant, abusive and in contempt of Court that the ‘Kamra ta’ l-Ispizjara ta’ Malta’ thinks that it can stand as judge and jury in the interpretation of the laws of our country and is not prepared to abide by the rule of law”.
He also said that it is “incorrect” for the chamber to continue insisting that the Health Authorities are unable to issue a temporary licence under the Medicines Act, Chap 458 of the Laws of Malta when there is a material change in circumstances for the relocation of a pharmacy due exceptional circumstances not brought about or requested by the licence holder.
“The law does not cater for these exceptional circumstances and the Superintendent of Public Health is empowered and obliged under these circumstances to issue such licence in the interest of justice as otherwise the title holder of the said licence can find himself in breach of the said law because of his obligations to render an uninterrupted public service in the interest of public health according to law,” Fava added.
Fava insisted that the result of this case proves that the citizen has been empowered and safe-guarded in his rights against potential or real threats by third parties imposed on government or its officials adding that “the citizens of this country have rights which are safe-guarded by an independent judiciary”.
