CCTV not covered by legislation: it’s a fact

In reply to Anthony Girard's letter published on 27 July, where he lamented being given a CCTV parking ticket outside Cafe Ole by the St Julian’s local council, on bus strike day, he and the general public should be made aware that CCTV equipment was NOT and is still NOT covered by legislation.
If you were caught by CCTV and you feel hard done by, ask the Tribunal during the sitting to indicate under which law the still photographic images and recordings taken by a CCTV camera are deemed as evidence and not mere "hearsay". You will get no answer.
Motor Vehicle Regulation 127 (3) (Legal Notice 65.11) was, in 2004, amended to cater for the introduction of speed cameras. CCTV cameras are clearly not “speed monitoring devices” according to Regulation 127 (3), and the lawmakers have not bothered to include them. The CCTV photo is no proof at law or in fact. Local Councils know about this as the above defence has been accepted by the Tribunal in a case I contested over a year ago.
